Terms of Service

FormSignal is operated by Big Bald Guy Software, LLC, a Maryland limited liability company ("FormSignal," "we," "us"), with a mailing address at 614 Schley Ave, Frederick, MD 21702.

You must be at least 18 years old to use FormSignal. By using FormSignal you represent that you are 18 or older, have the legal capacity to enter into these Terms, and have not been previously banned from FormSignal.

You are responsible for maintaining the confidentiality of your account credentials and for everything that happens under your account. Notify us promptly at legal@bbgsoft.com if you suspect unauthorized access.

If you join via a gym, your gym's administrator may provision or remove your access. Your relationship with the gym is governed separately by your agreement with them.

• FormSignal offers free and paid subscription tiers. Paid subscriptions auto-renew at the end of each billing period (monthly or annual, as you selected) until cancelled.
• Payments are processed by Stripe, Inc.; you authorize us to charge your payment method for the subscription fees and applicable taxes.
• Cancellation takes effect at the end of the current billing period. You can cancel anytime from Settings → Manage billing.
• No refunds. Except where required by law, fees already paid are non-refundable. We do not pro-rate cancellations.
• Price changes. We may change pricing for future billing periods with at least 30 days' email notice. Continued use after the effective date of the change constitutes acceptance.
• Free tier. The free tier is provided as-is and may be modified or discontinued at our discretion.

You agree not to:

• Upload another person's health, biometric, or personal data without their explicit consent.
• Impersonate any person, falsely claim a coach or admin role, or misrepresent your affiliation with a gym.
• Interfere with or disrupt FormSignal, including attempting to bypass security, rate limits, audit logs, or access controls.
• Scrape, harvest, or otherwise extract data from FormSignal except via documented APIs and within the limits we publish.
• Use FormSignal to violate any law, regulation, or third-party right.
• Reverse-engineer, decompile, or attempt to derive the source code of FormSignal except as expressly permitted by applicable law.
• Resell, sublicense, or commercially exploit FormSignal without our written permission.

FormSignal provides wellness and fitness information and tools. It is not a medical device, is not intended to diagnose, treat, cure, or prevent any disease, and is not a substitute for professional medical advice.

The body composition estimates, predictions, recovery scores, and similar outputs in FormSignal are informational only. Always consult a qualified healthcare professional before making decisions about your health, diet, training load, or any medical condition.

FormSignal does not provide medical advice and is not a HIPAA-covered entity or business associate.

FormSignal uses large-language-model providers (such as Anthropic, OpenAI, and Google) to draft suggested coach messages and summaries. A human coach reviews and edits every AI-drafted message before it is sent to a member. AI outputs may contain errors and should not be relied on as authoritative. The reviewing coach is responsible for the final content of any message sent.

You retain ownership of the data, photos, messages, and measurements you submit to FormSignal ("Your Content"). You grant FormSignal a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely as necessary to provide and improve FormSignal and to comply with law. This license terminates when you delete Your Content or close your account, except as required for backups, legal compliance, or fraud prevention.

FormSignal, its logos, software, documentation, and the look and feel of the service are owned by FormSignal or its licensors and are protected by intellectual property laws. Except for the limited license to use the service granted by these Terms, we reserve all rights.

You may stop using FormSignal at any time. We may suspend or terminate your access if you violate these Terms, fail to pay subscription fees, or in our reasonable judgment use FormSignal in a manner that exposes us or other users to legal, security, or operational risk.

On termination, your right to use FormSignal ends immediately. Sections that by their nature should survive (Sections 6, 7, 9, and 11 through 17) will survive termination.

FormSignal is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any information obtained via FormSignal is accurate or reliable. Use of FormSignal is at your own risk.

To the maximum extent permitted by law, in no event will FormSignal, its affiliates, or its or their officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of (or inability to use) FormSignal, whether based in contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

In any case, FormSignal's aggregate liability arising out of or related to these Terms or your use of FormSignal will not exceed the greater of (a) the amount you paid to FormSignal in the twelve months preceding the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such law applies to you, some or all of the exclusions and limitations above may not apply, and you may have additional rights.

Please read this section carefully. It affects your legal rights.

Agreement to arbitrate. You and FormSignal agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of FormSignal (each, a "Dispute") through final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures then in effect. The arbitration will be held in Wilmington, Delaware, or another mutually agreed location, or conducted by telephone or videoconference. The arbitrator's decision will be final and may be entered as a judgment in any court of competent jurisdiction.

Exceptions. You and FormSignal may bring individual claims in small-claims court if eligible, and either party may seek injunctive or equitable relief in court to protect intellectual property rights or prevent unauthorized access to the service.

Class action waiver. You and FormSignal agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding.

30-day opt out. You may opt out of this arbitration agreement by sending written notice of your decision to opt out to legal@bbgsoft.com within 30 days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.

If any portion of this Section 13 is found unenforceable, that portion will be severed and the remainder will remain in effect.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. To the extent any Dispute is not subject to arbitration under Section 13, you and FormSignal submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware.

You agree to defend, indemnify, and hold harmless FormSignal and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your violation of any law or third-party right, or (c) Your Content.

We may modify these Terms from time to time. When we make material changes, we will update the effective date and notify you by email or through the service before the changes take effect. Your continued use of FormSignal after the effective date of the changes constitutes acceptance. If you do not agree to the changes, your sole remedy is to stop using FormSignal and cancel your subscription.

• Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and FormSignal regarding the service.
• Severability. If any provision is held unenforceable, the remaining provisions will remain in effect.
• No waiver. Our failure to enforce any right or provision will not be a waiver of that right or provision.
• Assignment. You may not assign these Terms without our prior written consent. We may assign them without restriction in connection with a merger, acquisition, financing, or sale of assets.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
• Notices. We may send notices to the email address on your account or via in-product messaging. You may send legal notices to legal@bbgsoft.com with a copy to Big Bald Guy Software, LLC, 614 Schley Ave, Frederick, MD 21702.
